Dutch Court Grants SMi an Emergency Injunction - IB Consultancy Found to Have Unlawfully Used SMi's Confidential Information
On 5th December 2011, the District Court of The Hague, Netherlands handed down a judgment in favour of SMi Group Limited against IB Consultancy B.V. (incorporated in 2009 and managed by Mr Ilja Bonsen) and Daniel and Marta Levy.
Having reviewed the detailed evidence put forward by SMi and following a detailed Court hearing in The Hague, the Judge has found that Daniel and Marta Levy (both previous employees of SMi) had illegally taken confidential information belonging to SMi and made use of that information for the benefit of their new employer, IB Consultancy.
The Judge also agreed with SMi and found that IB Consultancy had obtained an unlawful advantage from using SMi's confidential information in order to organise a CBRN-E conference in Bangkok in April 2012.
Consequently, the Judge granted wide ranging injunctions against IB Consultancy and Daniel and Marta Levy.
These injunctions:
1. Prohibit IB Consultancy and Daniel and Marta Levy from holding their planned CBRN-E conference scheduled for 23-27 April 2012 in Bangkok.
2. Order IB Consultancy and Daniel and Marta Levy immediately to cease and desist from any infringement of SMi's copyrights.
3. Order IB Consultancy and Daniel and Marta Levy to destroy all of SMi's confidential information.
4. Any breaches of these injunctions by IB Consultancy and Daniel and Marta Levy are punishable by substantial cost penalties.
SMi Group's 2nd annual CBRN-E Asia Pacific event will take place in Singapore on 22nd and 23rd February 2012.
