Jury Finds Metaswitch Infringes 7 GENBAND Voice-Over-IP Patents
PLANO, Texas, Jan. 18, 2016 /PRNewswire/ -- On Friday, January 15, 2016, a jury in the United States District Court for the Eastern District of Texas returned a verdict finding that Metaswitch Networks Ltd and Metaswitch Networks Corp. infringes seven GENBAND patents.
The jury's decision marked an important milestone in its effort to address Metaswitch's widespread use of GENBAND's patented technology, which covers a range of Voice-Over-IP technology. Mr. David Walsh, GENBAND's CEO, said, "I want to express my sincere appreciation for the time and careful attention the Court and the jury gave this important case." GENBAND intends to seek a permanent injunction and other relief from Metaswitch's infringement.
During trial, GENBAND presented evidence that certain Metaswitch products infringe claims of U.S. Patent Nos. 6,791,971; 6,885,658; 6,934,279; 7,995,589; 7,047,561; 7,184,427; and 7,990,984.
Among the Metaswitch products found to infringe are:
- Metaswitch's Session Border Controllers;
- Metaswitch's Integrated Softswitches;
- Metaswitch's Call Feature Servers;
- Metaswitch's Universal Media Gateways; and
- Metaswitch's MTAS platform with both Accession (supporting Call Jump) and Commportal software (supporting Click to Dial).
The jury awarded $8.1 million to GENBAND, representing its finding of awardable money damages for the period of January 2014 through August 2015. The jury also confirmed the validity of GENBAND's asserted patents.
