As a leader in the Client Monitoring and Case Evaluation Group, Auld regularly works with his team to identify and analyze investment-related matters on behalf of institutional investors potentially damaged by the conduct at issue. He also takes an active litigation role in those cases which directly involve his buy-side investor clients.
Auld, on behalf of his clients, is currently directly involved in three major securities fraud class actions: In re MF Global Holdings Limited Securities Litigation, the case arising from the dramatic collapse of MF Global, the eighth largest bankruptcy in U.S. history; In re Computer Sciences Corporation Securities Litigation, the action against Computer Sciences, one of the world's primary providers of information technology services; and In re Chesapeake Energy Corp. Securities Litigation, which alleges Chesapeake engaged in a deceptive scheme to obscure the true value of its publicly-traded stock.
International Litigation Practice
As a result of changing legal regimes worldwide, increased investor portfolio exposure to global securities, and the catalyzing effect of the seminal 2010 U.S. Supreme Court decision in Morrison v. National Australia Bank, investors trading listed securities on markets outside the U.S. -- regardless of whether those securities are also traded inside the U.S. in an established market or format -- have increasingly been obligated to litigate securities claims in the jurisdictions in which they traded. As a result, there has been a notable increase in the number of major securities-related lawsuits being proposed, filed, and resolved in foreign jurisdictions. In response to rising client interest and demand, Auld has taken the lead in developing Labaton Sucharow's International Litigation Practice, placing the Firm at the forefront of this growing trend. Labaton Sucharow is one of the first U.S. firms to create such a comprehensive securities practice group for its clients.
Auld leads the group - which consists of a team of experienced attorneys, investigators, and financial and trading analysts with collective familiarity of multiple international jurisdictions. In this role, he develops and manages the Firm's representation of institutional investors in securities and investment-related cases filed outside the United States. As such, he regularly advises the Firm's U.S. and global clients regarding litigation taking place in Europe, Australia, Asia, and across his native country of Canada.
"Our work with both domestic and international clients continues to grow with the ongoing need for investors to appropriately safeguard their beneficiaries' interests, regardless of the countries in which they are invested," said Lawrence A. Sucharow, Chairman of the Firm. "Dominic has already played a critical role in supporting our clients in international jurisdictions and we are excited for him to continue to build this new practice, furthering our commitment to best protect our clients here and abroad."
Ms. Metzger joined the Firm specifically to support the International Litigation Practice. She was previously at Dewey & LeBoeuf LLP, where she litigated securities, employment, insurance/reinsurance, and intellectual property cases, including class actions, on behalf of Fortune 500 companies in both state and federal courts. Metzger currently concentrates her practice on analyzing the merits, structure, parties and risks of participation in international securities litigation matters and providing timely advisory and liaison services in connection with these matters.
